Since the 9/ 11 attacks, the Bush administration became more vocal in bringing to the forefront the war on terror. Subsequently, the invasion of Afghanistan and to some extent Iraq led to capture of various terror suspects. However, the war on terror has been dogged with many controversies including accusations of human rights abuses, and hence it is necessary to highlight on civil liberties, and writ of habeas corpus in the war on terror. There are disagreements on whether to grant the writ of habeas corpus to captured enemy combatants held in Guantanamo. Even with provisions clearly stated in the constitution, there are suggestions that the Bush administration went overboard in circumventing on the issue of habeas corpus, for detainees held at Guantanamo Bay.
