The concept of judicial review is what has led to the Supreme Court we know today–a court that has the power to question the decisions of Congress and the President and to serve as the protector of the U.S. Constitution. This power was not clearly laid out in the Constitution. It came about in one of the most significant cases of all time, Marbury v. Madison.
